Vice President Jagdeep Dhankhar Questions Judiciary On Democratic Nation Ntc

Jagdeep Dhankhar on Judiciary: Vice President Jagdeep Dhankhar said on Wednesday that it is not good for democracy to invalidate the law made by Parliament by any other institution. At the same time, when the Supreme Court repealed the National Judicial Appointments Commission (NJAC) Act in 2015, he said that ‘this has not happened anywhere in the world’. Dhankhar was addressing the inaugural session of the All India Presiding Officers Conference in the Rajasthan Legislative Assembly.

Talking about constitutional institutions operating within their limits, the Vice President said, ‘Can the right of Parliament to amend the Constitution depend on any other institution. Is there any new ‘theatre’ (institution) in the Constitution of India, which will say that the law made by the Parliament will be law only if we put our stamp on it.

Referring to a Supreme Court bench asking the Attorney General to convey a message to constitutional authorities to refrain from making statements on the collegium system, Dhankhar said, “I refused to hear the Attorney General on this point. I cannot be a party to weakening the powers of the legislature.

He said, “Today, this one-sided and public attitude from the judicial forums is not good. These institutions should know how to behave.” It is noteworthy that on December 8, a bench headed by Justice SK Kaul had asked Attorney General R Venkataramani to advise the government in this regard. A day earlier, in his first speech as the Chairman of the Rajya Sabha, Dhankhar had criticized the judiciary for repealing the NJAC Act.

Then he had said, “There is no instance of such an incident in democratic history, where a duly valid constitutional law has been judiciously brought back to its earlier position.” This is a glaring example of serious compromise of parliamentary sovereignty and disregard of people’s mandate, whose patrons are this House and the Lok Sabha.” It is worth mentioning that along with Dhankhar and Birla, Deputy Chairman of Rajya Sabha Harivansh, Chief Minister Ashok Singh were present in the inaugural session of the conference. Gehlot and Speaker of Rajasthan Legislative Assembly Dr. CP Joshi were also present.
